2. INFORMAÇÕES

Ao aceitar esta Política de Privacidade, o Usuário fica informado de que os dados pessoais que fornecer através do Site localizado na URL https://www.goiko.com/ (daqui em diante, o “Site”), ou que sejam fornecidos por terceiros através do Site, assim como os dados derivados de sua navegação e outros dados que o Usuário possa fornecer no futuro, serão tratados pelo GOIKO como responsável pelo tratamento, para as finalidades indicadas nesta Política de Privacidade.

O registro dos Usuários no Site implicará o acesso identificado ao mesmo e o usufruto dos conteúdos próprios do perfil de cliente registrado.

Os Usuários devem ler atentamente esta Política de Privacidade, que foi redigida de forma clara e simples.

3. OBRIGATORIEDADE DE FORNECER OS DADOS

Os dados solicitados nos formulários do Site são, em geral, necessários, e portanto obrigatórios, para cumprir as finalidades para as quais estão sendo recolhidos, salvo quando especificado de outra forma no campo solicitado.

Neste sentido, se o Usuário não fornecer os dados ou fornecê-los de forma incorreta, as finalidades para as quais foram coletados não poderão ser atingidas, sem prejuízo de que o Usuário poderá navegar livremente pelo Site.

4. ORIGEM DOS DADOS

Os dados tratados pelo GOIKO para as finalidades listadas na seção seguinte provêm de:

  1. Do próprio Usuário: os dados fornecidos pelo próprio Usuário através do formulário de registro no Site, conforme os consentimentos que, se for o caso, o Usuário der ao GOIKO.

  2. De fontes de terceiros: GOIKO conta com a colaboração de alguns terceiros que podem fornecer dados pessoais do Usuário como consequência de uma prestação de serviço, sempre em conformidade com as finalidades das solicitações dos Usuários. Por exemplo, plataformas de intermediação e entrega online entre restaurantes e clientes.

Além disso, os dados podem vir de fontes de terceiros relacionados ao uso do Site pelo Usuário e à sua navegação (através de cookies ou dispositivos de armazenamento e recuperação de dados de terceiros).

5. PARA QUAIS FINALIDADES O GOIKO TRATARÁ OS DADOS DO USUÁRIO?

GOIKO tratará os dados do Usuário para as seguintes finalidades específicas:

a) Gestão da relação contratual com o Usuário:

  • Gerenciar o cadastro e a exclusão do Usuário registrado no Site,

  • Prestação dos serviços oferecidos pelo GOIKO, incluindo gestão e/ou entrega de pedidos e reservas,

  • Gerenciar a solicitação de faturas através da seção do Site destinada a esse fim.

b) Gestão e processamento da aquisição de um Giftcard: Gerenciar e processar o envio eletrônico do cartão presente para a pessoa selecionada.

c) Gestão da participação no programa ‘Friends With Benefits’: Gerenciar a adesão e exclusão do Usuário no referido programa, além de gerenciar os benefícios do programa relacionados ao serviço oferecido pelo GOIKO.

d) Notificações push sobre os serviços de ‘Friends With Benefits’: Enviar notificações push relativas aos serviços de ‘Friends With Benefits’ por meio do sistema de notificações do seu Smartphone ou Tablet (por exemplo, sobre confirmação de pontos do Usuário, informações sobre descontos ou outras transações).

e) Responder às questões feitas pelo Usuário através dos canais de contato habilitados, incluindo redes sociais: Gerenciar, processar e dar suporte a solicitações, incidentes, reclamações ou consultas feitas pelo Usuário.

f) Gerenciar a participação em promoções, sorteios, iniciativas e concursos do GOIKO: Gerenciar e contactar participantes e vencedores, além de entregar prêmios e publicar o resultado do sorteio através dos canais de comunicação do GOIKO.

g) Gerenciar sua candidatura enviando seu CV: Gerenciar e avaliar possíveis processos de seleção e/ou vagas existentes no GOIKO.

h) Realizar pesquisas de satisfação: Conhecer o grau de satisfação e qualidade dos produtos e serviços oferecidos pelo GOIKO.

i) Enviar comunicações comerciais e promocionais: Enviar comunicações comerciais sobre produtos e serviços similares, caso o Usuário tenha dado seu consentimento.

j) Elaborar um perfil comercial: Criar um perfil comercial com base nas informações fornecidas pelo Usuário para enviar comunicações comerciais que possam ser de seu interesse.

k) Cumprir com obrigações legais: Quando necessário para cumprir uma obrigação legal derivada do direito espanhol ou europeu.

l) Elaboração de relatórios, estatísticas e análises internas: Melhorar os serviços do Site com base na análise e gestão dos comportamentos dos Usuários.

m) Prevenção e controle do uso ilegal do Site: Prevenir e controlar a utilização do Site com fins ilegais ou não autorizados.

n) Otimização dos serviços e detecção de erros: Melhorar e otimizar os serviços, além de detectar problemas técnicos.

o) Videovigilância: Garantir a segurança nas instalações do GOIKO e proporcionar uma melhor experiência ao usuário.

6. QUAIS DADOS DO USUÁRIO O GOIKO TRATARÁ?

Durante o uso do Site, os seguintes dados pessoais podem ser tratados:

Gestão da relação contratual com o Usuário:

  • Dados identificativos: nome, sobrenome, idade e documento de identidade.

  • Dados de contato: endereço postal, e-mail e número de telefone.

  • Dados obtidos através do conteúdo gerado pelo Usuário: comentários.

  • Dados econômicos: dados do cartão de pagamento.

  • Dados de saúde: informações sobre alergias ou outros dados que o Usuário queira fornecer ao GOIKO.

Gestão do programa ‘Friends With Benefits’:

  • Dados identificativos: nome, sobrenome, data de nascimento e código postal.

  • Dados de contato: e-mail e telefone.

  • Dados econômicos: dados do cartão de pagamento.

  • Dados pessoais: gênero (opcional).

Outros dados:

  • Dados de navegação: IP, comportamento no Site.

Se o Usuário fornecer dados de terceiros, ele deve garantir que tem consentimento ou legitimidade suficiente e comprometer-se a transmitir-lhes a informação desta Política de Privacidade.

7. QUAL É A LEGITIMIDADE DO TRATAMENTO DOS DADOS DO USUÁRIO PELO GOIKO?

O GOIKO trata os dados do Usuário com base nas seguintes bases legais:

a) Gestão da relação contratual com o Usuário: Cumprimento da relação contratual.
b) Gestão da aquisição de um Giftcard: Cumprimento da relação contratual.
c) Gestão do programa ‘Friends With Benefits’: Cumprimento da relação contratual.
d) Notificações push: Interesse legítimo, com base na atividade do Usuário.
e) Responder às questões feitas pelo Usuário: Consentimento.
f) Participação em promoções e sorteios: Consentimento.
g) Envio de CV para candidaturas: Consentimento.
h) Pesquisas de satisfação: Interesse legítimo.
i) Comunicações comerciais: Consentimento.
j) Elaboração de perfil comercial: Interesse legítimo.
k) Cumprimento de obrigações legais: Cumprimento de obrigação legal.

Os consentimentos obtidos são independentes, e o Usuário pode revogar um consentimento sem afetar os demais.

8. DATA CONSERVATION

The User’s personal data will be retained by GOIKO for the following periods:

a) Data provided for the management of the contractual relationship with the User: the data provided for managing, processing, formalizing, and complying with the contractual relationship will be retained for the duration of the relationship and, once concluded, for the period of limitation for any legal actions that may arise from it.

b) Management and processing of the purchase of a Giftcard: the data provided will be retained for six years, after which it will be blocked to address any potential liabilities that may arise.

c) Management of the ‘Friends With Benefits’ program: the data provided to manage, process, formalize, and comply with participation in the program will be retained for the duration of the participation and, once concluded, for the period of limitation for any legal actions that may arise from it.

d) Data used to respond to queries raised through the contact channels: the data will be retained for the period necessary to process and respond to the request, and once concluded, for the period of limitation for any legal actions arising from the request.

e) Data provided for managing participation in promotions, raffles, initiatives, and contests organized by GOIKO: the data will be processed for this purpose until the User withdraws consent, and if applicable, for the period of limitation for any legal actions that may arise from it.

f) Data provided for managing a job application via CV submission: the data will be retained for the duration of the selection process. Additionally, if the User grants consent, the data will be kept for one (1) year to notify them of new vacancies and to share their data with other companies in the group where selection processes suitable to their profile are initiated.

g) Data used to send satisfaction surveys: the data will be processed based on the legitimate interest of the data controller until the User objects to receiving such surveys.

h) Data used for sending commercial and promotional communications from GOIKO about products and services similar to those offered on the Website: the data will be processed for this purpose until the User withdraws consent.

i) Data used to send commercial communications from GOIKO about products and services not related to those offered on the Website, as well as from other companies GOIKO collaborates with: the data will be processed for this purpose until the User withdraws consent.

j) Data used to create a commercial profile based on information provided by the User to GOIKO: the data will be processed for this purpose until the User objects to the processing, and in no case will the period exceed one (1) year.

k) Compliance with legally established obligations: the data provided to comply with the obligations arising from the services offered by GOIKO will be retained for the periods established by law.

l) Data used for preparing reports, statistics, and/or analyses: the information will be used in an aggregated form for preparing reports, statistics, and analyses, for the necessary period to process and prepare such reports, statistics, and/or analyses, and once concluded, for the period of limitation for any legal actions arising from it.

m) Data used for the prevention and control of illegal or unauthorized use of the Website, with or without an economic purpose: the data will be retained for the necessary period to process and resolve the relevant issues, incidents, or violations, and once resolved, for the period of limitation for any legal actions that may arise from them.

n) Data used for optimizing services and detecting errors and problems on the Website: the data will be retained for the necessary period to process and develop the relevant optimization and error detection work, and once completed, for the period of limitation for any legal actions that may arise from them.

o) Data used as a result of using video surveillance systems: the data will be retained for thirty (30) days, unless needed to investigate any violation of national legislation, incident, or judicial or administrative requirement.

9. TO WHOM WILL THE USER’S DATA BE SHARED?

All personal data provided by the User through the Website may be communicated to:

a) Legal entities that are part of GOIKO GRILL GROUP, S.L., based on compliance with the contractual relationship and legitimate interest. Specifically, data may be shared with GOIKO GOURMET S.L.

b) Certified payment platforms, for the provision of payment services and secure electronic transactions.

c) Public Administrations, in cases provided by law, for compliance with a legal obligation.

d) Courts and Tribunals, in cases provided by law, for compliance with a legal obligation.

e) Collaborators providing services related to order management, based on compliance with the contractual relationship.

Additionally, GOIKO will collaborate with third-party service providers who may have access to the User’s personal data, and they will process the data on behalf of GOIKO for service provision. GOIKO follows strict supplier selection procedures to ensure compliance with data protection obligations, including signing the relevant data processing agreement in accordance with Article 28 of the GDPR.

Specifically, GOIKO will use third-party providers offering services in sectors such as legal advice and IT and technology services.

GOIKO will carry out international data transfers, as some of its service providers, particularly those in the technology sector, are located in the U.S., a country outside the European Economic Area, with whom GOIKO has signed Standard Contractual Clauses approved by the European Commission.

10. COMMERCIAL AND PROMOTIONAL COMMUNICATIONS

One of the purposes for which GOIKO may process personal data provided by Users (if they have authorized it or have not objected to the processing) is to send commercial communications with information about products, services, promotions, offers, events, or news relevant to Users.

11. USER’S RESPONSIBILITY

The User guarantees that the data provided to GOIKO is true, accurate, complete, and up-to-date. The User is responsible for the truthfulness of all the data they communicate and will keep the information updated to reflect their actual situation.

Furthermore, when the User provides personal data of third parties, they will ensure that these individuals have been informed of the contents of this document and have granted the necessary authorization for their data to be provided to GOIKO for the purposes mentioned.

Thus, the User will be responsible for any false or inaccurate information provided through the Website and for any direct or indirect damage caused to GOIKO or third parties as a result.

12. EXERCISING RIGHTS

As the data subject, the User can send a request to GOIKO, by email or postal address provided in the header of this Privacy Policy, at any time and free of charge, to exercise the following rights:

a) Right of Access: The User has the right to be informed about whether GOIKO is processing their personal data, and in such a case, to access such data and receive information about the purposes of the processing, the categories of data involved, the recipients to whom their personal data has been disclosed, and the expected retention period of the data, among other information.

b) Right of Rectification and Deletion: The User has the right to request the deletion of personal data if the legal requirements are met, and the rectification of inaccurate data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

c) Restriction of processing, withdrawal of consent, and objection to processing: In certain circumstances (for example, if the accuracy of the data is disputed, while verification is carried out), the User may request that the processing of their personal data be restricted, so that the data is only processed for the exercise or defense of claims.

The User also has the right to withdraw consent given and to object to processing at any time, for reasons related to their particular situation, when the processing is based on GOIKO’s legitimate interest or the legitimate interest of a third party (including processing for direct marketing and profile creation). In such cases, GOIKO will cease processing, unless legitimate reasons for processing are demonstrated.

d) Data Portability: The User has the right to receive the personal data they have provided to GOIKO in a structured, commonly used, and machine-readable format, and to transmit it to another data controller without GOIKO preventing the transfer, in the cases legally provided for such purposes.

e) Automated Individual Decisions: Additionally, in the case of automated decisions, including profile creation, the User has the right to obtain human intervention by GOIKO and to express their point of view and contest the decision.

f) Other: When personal data is transferred to a third country or an international organization, the User has the right to be informed about how to access or obtain copies of the safeguards related to the transfer.

The User may also file a complaint regarding the protection of their personal data with the Spanish Data Protection Agency at C/ Jorge Juan, 6, 28001 – Madrid, if they believe that GOIKO has violated their rights under applicable data protection regulations.

13. SECURITY MEASURES

GOIKO will process the User’s data at all times in an absolutely confidential manner and will maintain the mandatory duty of secrecy regarding them, in accordance with the applicable regulations, adopting the necessary technical and organizational measures to ensure the security of the data and prevent its alteration, loss, unauthorized processing, or access, taking into account the state of the technology, the nature of the stored data, and the risks to which it is exposed.

14. CHANGES

GOIKO reserves the right to review its Privacy Policy whenever it deems appropriate. For this reason, we kindly ask the User to regularly check this privacy statement to read the most recent version of GOIKO’s Privacy Policy.

15. ACCEPTANCE AND CONSENT

The User declares that they have been informed about the conditions regarding personal data protection, and they accept the content of this Privacy Policy.
